MoneyHome Terms and Conditions – Swiss and International Transfers

These Terms and Conditions (the “Terms”) govern your access to and use of the MoneyHome website and mobile application (collectively, the “Platform”) and the MoneyHome money transfer service (the “Service”) provided by MH World GmbH.

By downloading, accessing or using the Platform, creating a Profile or initiating a Transfer, you confirm that you have read, obtained and agree to be legally bound by these Terms and our Privacy Notice (collectively, the “Agreement”). If you do not agree, do not use the Platform or the Service.

1. Information about MoneyHome

1.1 Provider.

The Service is provided by MH World GmbH (“MoneyHome”, “we”, “us”). MH World GmbH is a limited liability company incorporated in Switzerland, with its registered office at c/o IncoSwiss AG, Bahnhofplatz, 6300 Zug, Switzerland (company registration number: CHE-439.152.781) and operating office at Bubenbergplatz 8, 3011 Bern, Switzerland.

1.2 Regulatory Status (AML)

MoneyHome is a financial commission affiliated with ARIF (Association Romande des Intermédiaires Financiers), Rue de Rive 8, 1204 Geneva, Switzerland, a self-regulatory organization recognized by the Swiss Financial Market Supervisory Authority (FINMA).

ARIF is a self-regulatory organisation (SRO) recognised by FINMA. MoneyHome's affiliation demonstrates our commitment to Swiss anti-money laundering regulations and financial compliance standards.

1.3 Scope.

These Terms apply to money transfers initiated through our Website, App, or at our physical location in Bern. Product- or corridor-specific terms may apply in addition to these Terms and are available at www.money-home.com/terms.

1.4 Ombudsman (FinSA) and OFS disclosure.

MoneyHome is affiliated with an ombudsman for mediation proceedings and informs clients of this possibility, including the ombudsman’s name and address.

The Swiss Banking Ombudsman (OFS) provides independent dispute resolution for financial services. Customers may submit complaints to OFS if they are not satisfied with MoneyHome's internal complaint handling.

2. Definitions and Interpretation

2.1 Definitions.

In these Terms:

“App” means the MoneyHome mobile application.

“Website” means the MoneyHome website and related web pages.

“Profile” means the Sender’s account/profile created on the Platform.

“Sender” means the person initiating a Transfer.

“Recipient” means the person designated to receive a Transfer.

“Transfer” means a money transfer order submitted via the Service.

“Send Amount” means the amount the Sender requests to send.

“Receive Amount” means the amount the Recipient is expected to receive.

“Fees” means transfer fees charged by MoneyHome.

“Third-Party Services” means services provided by third parties.

2.2 Interpretation.

Singular includes plural and vice versa.

Headings are for convenience and do not affect meaning.

“Including” means “including without limitation”.

References to laws include amendments and replacements.

3. The Platform (Website & App)

3.1 Platform availability.

The Platform may be updated, changed, suspended, or discontinued (in whole or in part) for operational, security, legal, or business reasons. We do not guarantee uninterrupted availability.

3.2 Eligibility.

The Platform and Service are available only to individuals 18 years or older and not to persons who have been suspended or removed by MoneyHome.

3.3 Electronic communications.

You agree that we may provide confirmations, receipts, notices, disclosures, and other communications electronically (including by email, SMS/WhatsApp where applicable, or in-app notification). Electronic acceptance and confirmations are binding.

3.4 Registration and Profile.

Creating a Profile may require identity verification.

You must provide accurate and up-to-date information.

You must promptly inform us of changes to your personal details as this may affect verification and transaction processing.

You are responsible for all activity through your Profile.

3.5 Security.

You must protect your device, login credentials, and access. Notify us immediately if you suspect unauthorised access.

3.6 Acceptable use.

You must not:
use the Platform for unlawful purposes;
attempt unauthorised access to systems;
upload malware or harmful code;
use automated tools without permission;
interfere with Platform security.

3.7 User submissions.

You remain responsible for any content you submit and must not submit illegal, abusive, or infringing content.

3.8 Third-party links.

The Platform may contain links to third-party services. We do not control or endorse third-party content.

3.9 Updates to Terms.

We may update these Terms from time to time. Updated Terms will be published on the Platform. Continued use means acceptance.

3.10 Geographic restrictions.

The Service may not be available in all countries or regions. We may restrict service based on legal or operational limitations.

4. The MoneyHome Service (Transfers)

4.1 Service description.

The Service allows sending money to a Recipient via Cash Pickup, Account Deposit, or Mobile Wallet (where supported).

4.2 Funding methods.

Transfers may be funded via cash, debit card, or bank transfer. We may request additional documentation.

4.3 Prohibited use.

The Service must not be used for illegal purposes, including money laundering, terrorist financing, sanctions evasion, fraud, or tax evasion.

4.4 Compliance checks, source of funds, and verification.

We engage third-party verification providers, to verify your identity. By using the Service, you explicitly consent to:
(i) the processing of your identification documents;
(ii) the processing of your biometric data (e.g., facial scan, video liveness check); and
(iii) providing information on the purpose of the Transfer and source of funds/wealth where required.

You acknowledge that we may use automated systems to screen transactions. If you do not provide requested information, we may delay, refuse, or cancel processing where permitted.

4.5 Transfer limits.

We may apply limits per Transfer, per day/month, by corridor, funding method, verification level, or risk profile.

4.6 Network and Confidential Partners.

To provide the Service globally, we utilise a network of intermediaries, banks, aggregators, and payout agents (“Partners”). You acknowledge and agree that some of these commercial relationships are confidential. While MoneyHome remains your service provider and primary point of contact, we are not obliged to disclose the specific identity of every underlying infrastructure Partner unless required by applicable law or regulatory authorities. 

5. Transfer Orders

5.1 Pre-transaction information.

Before submitting, we display: Send Amount, Receive Amount, Fees, exchange rate, and estimated delivery time.

5.2 Submission requirements.

The Sender must:
(i) acknowledge fraud warnings;
(ii) accept these Terms;
(iii) consent to execution; and
(iv) confirm details are accurate.

5.3 Acceptance.

A Transfer is accepted once MoneyHome confirms acceptance by email or in-app notification.

5.4 Delivery times.

Transfers to Sri Lanka or India typically take up to five (5) business days. Times may vary due to compliance checks, holidays, or incorrect details.

5.5 Refusal.

We may refuse where:
(a) it could breach law/regulation;
(b) expose us to regulatory action;
(c) we suspect fraud/sanctions risk; or
(d) required by policies.

6. Cash Pickup Conditions

6.1 Recipients may collect at partner/agent locations during operating hours, subject to local restrictions.

6.2 The Sender must inform the Recipient when funds are available.

6.3 The Recipient must provide identification and required transaction details.

6.4 Confidentiality.
Keep the reference number confidential and share only with the intended Recipient.

6.5 Expired transfers.
If not collected within 60 days, we have no obligation to execute it.

6.6 Refund after expiry.
We will attempt to contact the Sender to arrange a refund. 

7. Account Deposit Conditions

7.1 We will make the Receive Amount available to the specified account within the execution time communicated.

7.2 Transfers are usually completed within five (5) business days for Sri Lanka and India; delays may occur.

7.3 Incorrect Recipient details.
The Sender is responsible for providing correct Recipient details. If details are wrong or incomplete, recovery may be impossible once funds are deposited (especially for Mobile Wallets, which are often instant and irrevocable). We may attempt to assist where feasible but do not guarantee recovery; partner/bank fees may apply.

7.4 Rejection/returns.
Banks may reject or return funds. We will refund the Sender the returned amount minus third-party charges. 

8. Cancellations and Refunds

8.1 Cancellation.
Once accepted, a Transfer is generally irrevocable. However, the Sender may request cancellation if the Transfer has not yet been collected/received/credited (as applicable). Transfers to Mobile Wallets are generally instant and cannot be cancelled once executed. If cancelled, we refund the Send Amount (unless mandatory law requires otherwise).

8.2 Unauthorised transfers.
If unauthorised or executed incorrectly, we will refund the Send Amount and Fee per applicable law.

8.3 Time limit.
Notify us promptly. No refund if notified more than 13 months after acceptance.

8.4 Refund method.
Refunds are made to the original payment method where possible. 

9. Charges and Currency Exchange

9.1 Fees.
The Sender must pay Fees via the selected method. Card issuers may charge additional fees.

9.2 Recipient charges.
Local taxes/service charges may be levied. Recipient banks may charge receipt fees.

9.3 Exchange rate.
We use exchange rates based on market rates plus a margin. Rates change frequently.

9.4 Conversion at payout.
In some countries, conversion occurs at payout. The displayed rate may be an estimate.

9.5 USD display.
If shown in USD but payout not available in USD, payout may occur in local currency.

10. Complaints, Support and Ombudsman

10.2 Handling.
We handle complaints promptly and aim to resolve at the earliest opportunity.

10.3 Timeframes.
We aim to provide a final response within 15 business days, or 35 days in exceptional circumstances.

10.4 Ombudsman.
If not satisfied with our response, you may request mediation with OFS Ombud Finance Switzerland within 6 months. 

11. Privacy and Data Protection

11.1 We collect and process personal data to provide the Service, comply with legal obligations, prevent fraud, and operate the Platform.

11.2 Privacy Notice.
Available at www.money-home.com/privacy.

11.3 Marketing opt-out.
You may opt out using the “unsubscribe” option in the App or by contacting us. 

12. Disclaimers, Limited Warranty, and No Advice

12.1 No advice.
Information is for informational purposes only and does not constitute legal, financial, tax, or investment advice.

12.2 “As-is” Platform.
The Platform is provided “as is” and “as available”. We do not guarantee error-free or uninterrupted service.

12.3 Service descriptions.
We aim to describe the Service accurately but do not warrant completeness or absence of errors.

12.4 Errors.
We may correct errors, inaccuracies, or omissions at any time and may change information without notice. 

13. Liability

13.1 When not liable.
We are not obliged to execute if we cannot verify identity, suspect incorrect information, or where clause 5.5 applies.

13.2 Force majeure.
Not liable for failure caused by events beyond our reasonable control.

13.3 Indirect damages.
Not liable for indirect, incidental, special, or consequential losses.

13.4 Mandatory rights.
Nothing excludes liability for wilful misconduct, fraud, gross negligence, or death/personal injury. 

14. Intellectual Property

14.1 Copyright.
The Platform and all materials are owned by or licensed to MoneyHome and protected by IP laws.

14.2 Restrictions.
You must not copy, reproduce, modify, distribute, publish, reverse engineer, or commercially exploit any part.

14.3 Trademarks.
“MoneyHome”, logos, and brand elements are trademarks. You may not use them without permission. 

15. Suspension, Termination, and Effects

15.1 By MoneyHome.
We may suspend or terminate access at any time for security, fraud, compliance, legal, or policy reasons.

15.2 Your termination.
You may stop using the Platform at any time. Certain obligations and rights survive.

15.3 Effect.
Upon termination, we may stop providing the Service and disable access, subject to legal requirements. 

16. Indemnification

You agree to indemnify and hold MoneyHome harmless from claims arising from:
(i) your breach of these Terms;
(ii) misuse of the Platform/Service; or
(iii) your violation of laws or third-party rights. 

17. Miscellaneous

17.1 Severability.
If a provision is invalid/unenforceable, the remaining provisions remain effective.

17.2 No waiver.
Failure to enforce a provision does not waive the right to enforce it later.

17.3 Assignment.
We may assign/transfer this Agreement to an affiliate or successor, subject to applicable law.

17.4 Entire agreement.
These Terms plus referenced documents form the entire agreement.

17.5 Language.
If multiple language versions exist, the English version prevails unless mandatory law requires otherwise. 

18. Governing Law and Jurisdiction

18.1 Applicable Law.
These Terms and Conditions and the relationship between the customer and MoneyHome are governed by Swiss law. Any disputes are subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.

18.2 Card Processing Disputes.
All legal disputes related to card processing, including but not limited to payment card transactions, chargebacks, and card-related payment disputes, are governed exclusively by Swiss law and handled under the jurisdiction of the courts of Geneva, Switzerland. 

19. Mobile App Store Provisions (Apple & Google)

If you download the MoneyHome App from the Apple App Store or Google Play Store (each an “App Store”), you acknowledge and agree to the following additional terms:

19.1 Acknowledgement.
This Agreement is concluded between you and MoneyHome only, and not with Apple Inc. (“Apple”) or Google LLC (“Google”). MoneyHome, not the App Store, is solely responsible for the App and the content thereof.

19.2 Scope of License.
The license granted to you for the App is limited to a non-transferable license to use the App on any device that you own or control, and as permitted by the Usage Rules set forth in the App Store Terms of Service.

19.3 Maintenance and Support.
MoneyHome is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that the App Store provider (Apple or Google) has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

19.4 Warranty.
MoneyHome is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in these Terms. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

19.5 Product Claims.
You acknowledge that MoneyHome, not Apple or Google, is responsible for addressing any claims of yours
or any third party relating to the App or your possession and/or use of the App, including, but not limited to:
(i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory
requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
19.6 Intellectual Property Rights.

In the event of any third-party claim that the App or your possession and use of that App infringes that third party’s intellectual property rights, MoneyHome, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

19.7 Legal Compliance.

You represent and warrant that:
(i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and
(ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

19.8 Third Party Terms of Agreement.

You must comply with applicable third-party terms of agreement when using the App (e.g., you must not be in violation of your wireless data service agreement when using the App).

19.9 Third Party Beneficiary.

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

By using MoneyHome’s services, you acknowledge that you have read, understood, and agreed to these Terms

• Determine purpose and nature of business relationships
• Conduct ongoing monitoring

Fraud Warning

Never send money to someone you don't know. Be wary of emergency requests, lottery winnings, or online romantic relationships. MoneyHome will never ask you to send money to yourself or transfer on behalf of others.
